Scope
These General Terms and Conditions for the Sale of Products ("GTC") govern (together with the following documents Privacy Policy and the Return & Repair Policy) the offer and sale of products of Smart-Cam GmbH ("Products") on the website https://www.smart-cam.ch.
Please read these GTC thoroughly before ordering a product on the website. By ordering our products on the website, you agree to be bound by these GTC.
The offered products are distributed by Smart-Cam GmbH with registered office/domicile in Switzerland, Industriestrasse 40, 8404 Winterthur.

Our deliveries, services, and offers are made exclusively on the basis of these General Terms and Conditions. We offer our products for sale on the website exclusively to consumers, i.e., any natural person who is acting for purposes which are outside their trade, business, or profession. If you are not a consumer, please do not purchase products on the website. We reserve the right not to process orders from users who are not consumers, as well as orders that do not comply with our business principles.

Contract Conclusion
The presentation of products in our webshop does not constitute a binding offer to conclude a purchase contract, but rather a non-binding invitation to order.
By clicking the "Order Now" button, you submit a binding purchase offer. After receiving the purchase offer, you will receive an automatically generated email (acknowledgment of receipt), which does not yet constitute acceptance of your purchase offer. A contract is only concluded upon dispatch of the product and the confirmation email, which contains information about shipping, product details, prices, and delivery costs.
Smart-Cam GmbH reserves the right not to accept orders at its own discretion. By submitting your order, you accept these GTC as well as other conditions (including privacy policy and return/repair policy).
Prices
The prices stated on the product pages include the statutory value added tax and are exclusive of shipping costs. Price changes are reserved but do not affect orders already placed. Prices are only considered confirmed when you receive the order confirmation email.
Payment can be made by credit card, PayPal, PostFinance E-Finance, PostFinance Card, advance payment by bank transfer, or TWINT.
When paying by credit card, the amount is reserved at the time of ordering; the charge is made upon dispatch of the goods.
We use Cybersource as a secure online payment portal. Your data is transmitted encrypted and used exclusively for payment processing, refunds, or fraud prevention.
Credit Check and Scoring
Smart-Cam GmbH reserves the right to obtain credit information about the customer. For this purpose, customer data may be transmitted to third parties, in particular to CRIF AG, Hagenholzstrasse 81, 8050 Zurich. They check creditworthiness using mathematical-statistical procedures.
Purchase on Account / Default Charges
Invoices must be paid within 20 days. In case of late payment, default interest of 5% as well as reminder fees of CHF 20 will be charged. In case of further non-payment, the claim may be assigned to a collection agency.
Legal Enforcement/Collection Costs in Case of Payment Default

- CHF 601-1000 → max. CHF 230
- CHF 1000.01-10,000 → max. CHF 860
- from CHF 10,000.01 → 9% of the outstanding claim
Transfer of Personal Data
Your data will be passed on to transport companies or financial service providers within the framework of contract processing, insofar as this is necessary for delivery or payment.
Shipping and Delivery
Delivery is made to the address you provided (no delivery to PO boxes or military addresses). As soon as the order status is changed to "shipped", you will receive the tracking information.
We strive for punctual delivery but assume no liability for delays. If delivery does not take place within 30 days, you can withdraw from the contract. Upon delivery and signature, ownership passes to you.
Right of Withdrawal
You have the right to cancel this contract within 14 days without giving any reason. The deadline begins upon receipt of the goods.
To exercise the right of withdrawal, you must send a clear statement to Smart-Cam GmbH, Industriestrasse 40, 8404 Winterthur, or by email to info@smart-cam.ch.
In the event of a withdrawal, we will refund all payments (including delivery costs) within 14 days of receipt of the notification. The refund will be made using the same means of payment. We may withhold the refund until we have received the goods back or you have provided proof of return shipment.
You must return the goods to us within 14 days of the withdrawal. The return shipping costs are borne by you. Any loss in value must be compensated if it is due to improper handling.

Transport Damage
In the case of goods with obvious transport damage, please complain immediately to the deliverer and contact us immediately. The complaint does not affect your legal rights but helps us to assert our claims against the transport company.
Warranty
Unless otherwise agreed, the statutory provisions apply. Smart-Cam GmbH warrants that the delivered products comply with the specifications and are free from defects or manufacturing errors - for 12 months from the delivery date.
